By purchasing through this website you agree to be bound by the Terms and Conditions laid out below. These terms and conditions apply to online and Telephone transactions only and do not apply to any purchases made from visiting the store. It is important that Whether before or after You Purchase from us That You Read at least the first 2 or 3 paragraphs of the Terms and Conditions or The Delivery Information Section..These conditions do not affect your statutory rights as a Buyer.
“Buyer” means the Buyer who buys or agrees to buy Goods on this website from www.priestbrothers.co.uk. “Goods” means all products listed on the order and the order confirmation e-mail “Consumer” has the meaning given in section 12 Unfair Contract Terms Act 1977 “Special Items” mean any Goods that are not held in stock by Priest Brothers Ltd and are ordered and/or manufactured specifically for the Buyer. “Delivery” means the delivery of the Goods to the delivery address specified on the order.
Risk and Ownership
The Goods shall be at the Buyer’s risk once delivery has taken place. The Buyer must take all reasonable care of the Goods. Should the Goods be returned to Priest Brothers having been damaged while in the Buyer’s care, the cost of such damage will be recovered from the Buyer.
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.
Limitations of Liability
Our total liability in regard to the performance of this contract shall be limited to the value of the Goods. Priest Brothers shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract. Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law.
All contracts shall be governed by English Law.
Any order placed by the Buyer and accepted by Priest Brothers is subject to the following terms and conditions unless specified in writing by a Director of Priest Brothers.
A confirmation of your order will be sent automatically by e-mail and, unless you are notified to the contrary within 48 hours of this confirmation, the order will be deemed to be accepted by Priest Brothers
Priest Brothers retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
Description of goods
The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order. a receipt will be sent to the Customer by email as proof of his order , it is up to the Customer to check this receipt , in Order for Him/Her to Clarify what has been ordered . All sizes given are approximate and the Buyer should satisfy them self that the goods will fit into the delivery address. The Buyer should check the overall dimensions given for each product and be sure that they will fit in the room of choice.
Please note that all bed frames are supplied without mattresses. There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order (for example, bedside tables, lamps and bed covers). These will also be an extra cost or they may not even be available as they may have been used for photographic purposes only.
An initial deposit of 10-20% is required when the order is placed and the balance is due before the order is delivered.
Payment may be in the form of a debit/credit card or cash.
All Prices and charges include any V.A.T payable at the prevailing rate.
Delivery of orders within a 20 mile radius of Chelmsford is included in the sale price. For orders outside of this area are delivery rates in place based on the distance between your postcode and our warehouse.

Delivery of goods
We use our own transport to deliver most of our furniture but for longer distances we may use a professional courier service to deliver on our behalf.
- We will deliver to a room of your choice (providing that this is accessible and provides no health and safety risks to the delivery team).
- Deliveries are made Monday to Friday dependant on location.Some Postcodes will incur Delays Longer than 10 Days We Normally Quote. See Lead Times
- We will generally contact you 2 days before the day that they would like to deliver, and give you an approximate time slot for that day.
- If requested we will contact you 30 minutes prior to delivery.
Delivery of items from stock
Items that are in stock at our warehouse will be delivered within 14 working days.
Delivery of multiple items
Where multiple items have been purchased all items will be delivered in one shipment.
Please note delivery times will vary depending on stock availability, 6-8 weeks. However, occasionally delivery times may be affected by factors beyond our control and therefore they cannot be guaranteed. We will inform you if we become aware of any unexpected delay.
Other delivery information
It is the customers’ responsibility to make sure that the purchased items will fit and be able to be delivered into the room of choice. It is also the customer’s responsibility to remove all paintings, mirrors or any other objects that may hinder your product from going upstairs or that may get damaged during the delivery. Priest Brothers will not be held responsible for any damage caused to property during delivery.
Please note you need to check your goods when they are delivered, if you sign for something as being correct i.e. boxed well, no dents, marks or indentations, and then find the product has visible damage, there will be No possible claim against the Carrier or Priest Brothers. It is up to the customer to thoroughly check the product before signing for the goods.
Where the Goods cannot be delivered on the day arranged due to the fault of the buyer, Where the Delivery Company Have arranged Delivery with you the Customer , Only to find no one at Home on The Day of Delivery, Priest Brothers retains the right to charge a further shipping charge for “re-delivery” to cover costs incurred. This charge will be requested from the buyer who will subsequently be expected to pay the “re-delivery” charge before a further attempt at delivery is made. If the buyer is unable to accept delivery on the day submitted by the delivery company, a further date will be a need to be advised. Please note this may delay delivery of the buyers order by up to 2 weeks due to the fact that we may not cover certain areas of the country on a regular basis.
If Priest Brothers has failed to deliver the Goods within 60 working days of the order date due to its own neglect then the Buyer may either cancel the contract without penalty or ( if You have been advised the Delivery time will be Longer Prior to the Order or If it is on Your Receipt then this will be exempt from the 60 Day Rule) Priest Brothers will pay £20 for each complete week the Goods (over £250) are further delayed (maximum payable £60 per order).
Delivery will be made to the delivery address specified on the original order. If you wish to change the delivery address we may have to re-submit your payment method to verify the card holder’s details.
Delivery will be deemed to have taken place when the Goods have been delivered to the agreed address (Priest Brothers do not need to satisfy themselves that the person accepting delivery at the agreed address is authorised by the Buyer to accept the Goods).
All Goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery. After 12 months your guarantee reverts to the manufacturer’s warranty, for this to be valid it the responsibility of the buyer to retain the receipt of purchase and the manufacturer’s warranty card.
Refund & return of Goods
We hope you’ll be pleased with your purchase. If you should change your mind, and wish to return anything bought from Priest Brothers or our shops, we’ll be happy to refund or exchange a product providing it’s in fully resalable condition. Returns should be made within a reasonable time (usually 28 days) and in original, undamaged packaging.* Please see below for exceptions to this policy.
When you buy online or by phone, you have additional rights as a consumer under the Distance Selling Regulations. This means if you as the purchaser notify us in writing of your wish to return an item within 7 working days of receiving it, we’ll refund you for both the purchase price and the delivery charge. Please make sure you take reasonable care of the item while it’s in your possession, and that it’s returned to us unused.
If the product returned is not in fully resalable condition or the packaging is damaged, we do reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount. This does not affect your statutory rights.
Refunds can only be made to the original card of purchase. Refunds to a card other than the original can only be processed under the following circumstances:
- The original account no longer exists
- The original account details have expired
- The recipient requires a credit
Products we’re unable to refund or exchange
We’re unable to offer a refund or exchange on personalised, made-to measure/order or perishable goods (such as Made to Measure bespoke furniture in Specific Colours or Fabrics or Special Size) unless they’re faulty.
We’ll refund the purchaser any delivery charge paid when a product is faulty or damaged. Furthermore, should you buy a product online or by phone and you change your mind about it, providing you notify us in writing within 7 working days of receiving it, we’ll refund the purchase price and any delivery charge you may have paid. After 7 days we’ll refund the purchase price, but not delivery charges. *
Unwanted purchases of furniture
Please check the dimensions of the delivery address for access (including doors, corridors, stairs and corners) and the proposed location before ordering large pieces of furniture, i.e. large beds and sideboards, to ensure successful delivery, and to confirm that the product is the right size for your needs. Where large products are returned as unwanted, we reserve the right to make a charge of £50 to cover the collection cost. *
Cancellation of made-to-order products
Should you wish to cancel your made-to-order or made-to-measure product for any reason, it’s unlikely that we could sell it to another customer at full selling price. We’ll charge a cancellation fee of 20% of the full selling price if the order had not yet been produced. Once the product is in production it is down to the agreement of the management if the order can be cancelled. In respect of these products our usual refund policy does not apply, and products cannot be returned or exchanged unless faulty.*
*None of the above conditions affect your statutory rights when goods are faulty, or not as described. For your rights of cancellation under the Consumer Protection Distance Selling Regulations Refunds on Goods cancelled prior to delivery will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 30 days of that written notice. All refunds will be made onto the same card used to make the original purchase.
Note special sizes and made to measure beds are unable to be cancelled prior to delivery.
Refunds on Goods already delivered will take place as soon as possible following the collection, return and inspection of such goods and in any case will not exceed a period of 30 days following that collection/return.

When are you not entitled to anything?
- If you were told of any faults before you bought the goods. Or You Did Not Read the Terms and Conditions online before Purchase.
- If the fault was obvious and it would have been reasonable to have noticed it on examination before buying.
- If you caused any damage yourself.
- If you made a mistake, e.g. you don’t like the colour, it is the wrong size, etc.
- If you have changed your mind about the goods, or seen them cheaper elsewhere.
- If you have tried the product, used it, slept on it, and it cannot be returned and sold at full face value.
The Buyer may cancel the goods at any time within the cancellation period by giving Priest Brothers notice of the cancellation in writing or in another durable medium, prior to the goods not being delivered otherwise a charge may be levied.
Goods that have specially been made to order i.e. sofa beds, special size beds or mattresses cannot be cancelled if the goods have been made at time of the cancellation request.
